These Terms of Service (“Terms”) govern your access to and use of mophado.com (“Site”), owned and operated by Mophado LLC, a Wyoming limited liability company located at 30 N Gould St Ste N, Sheridan, WY 82801, United States (“we,” “us,” or “our”).

By accessing, browsing, or using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old or have parental/guardian consent to use the Site. By using the Site, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

2. User Conduct and Accounts

You agree to use the Site lawfully and in accordance with these Terms. Prohibited conduct includes:

• Uploading viruses, malware, or harmful code.
• Interfering with the Site’s functionality or security.
• Unauthorized access or attempting to gain access to restricted areas.
• Violating any applicable laws or third-party rights.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Orders and Payments

All products are custom-made to order (print-on-demand). Production begins after successful payment confirmation. All prices are in USD and displayed at checkout.

We may refuse or cancel any order (even after payment) for reasons including suspected fraud, pricing errors, product unavailability, or violation of these Terms. In such cases, we will issue a full refund to your original payment method. See our Payment Policy for details on accepted methods and processing.

4. Intellectual Property and User Content

All content, designs, trademarks, logos, and materials on the Site are owned by Mophado LLC or our licensors and protected by U.S. and international intellectual property laws. Unauthorized use is prohibited.

When you upload custom designs, images, or content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify (for production purposes), and display such User Content solely to fulfill your order.

You represent and warrant that your User Content does not infringe any third-party rights (including copyrights, trademarks, privacy, or publicity rights) and that you own or have all necessary rights to upload it. We reserve the right to refuse, remove, or reject any User Content that violates these Terms.

5. Disclaimers and Limitation of Liability

The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Mophado LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid for the product(s) giving rise to the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Mophado LLC, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your User Content, or your misuse of the Site or products.

7. Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, strikes, supply chain disruptions, war, government actions, or carrier delays.

8. Severability & No Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. You consent to the personal jurisdiction of such courts.

10. Changes to Terms

We may update these Terms at any time. Changes will be posted here with a revised “Last updated” date. Continued use of the Site constitutes acceptance of the updated Terms.
